ARTICLE 1 - IDENTITY

These General Terms of Use (hereinafter, “GTU”) apply whenever you access or use A3D's online or mobile services and websites, including but not limited to any mobile application and browser extension or plug-in (hereinafter, the "Site"), available at archited.io, which is the property of A3D (hereinafter, the "Company", “A3D”, “we”, “our”, “us”), a legal entity, whose address is Chemin du Cyclotron 6, 1348 Ottignies-Louvain-la-Neuve, Belgium, VAT BE 0794.136.228, registered with the Crossroads Bank for Enterprises (CBE) under number 0794.136.228. The Company reserves the right to modify these GTU at any time and thus we recommend that the GTU are reviewed on a regular basis by the User, such modifications to take effect on the "last updated" date indicated above. By using the Site, you accept the new version of the GTU.

The Company reserves the right, at its discretion and without prior notice, to interrupt or modify the Site in whole or in part.

ARTICLE 2 - DEFINITIONS

In these GTU, the following words have the following meanings:

  • "User" is the natural person browsing the Site.

ARTICLE 3 - WEBSITE

The Site is intended exclusively for private use, and its use and content may only be used for non-commercial purposes, except with the prior written authorisation of the Company.

The User may consult advertisements, view a catalogue, read information and other content related to 3D printing for private purposes. Use of the Site beyond these limits is only possible if the User has obtained explicit written consent from the Company.

This Site is intended only for persons legally capable of entering into contracts within the meaning of the Belgian Civil Code. By using this Site, you acknowledge that you are responsible for all financial and legal transactions, including those carried out on behalf of a third party.

The User must guarantee the confidentiality of all his/her access data to the Site (such as password, etc.) and must immediately notify the Company if he/she observes or suspects any unauthorized use of his/her user account. In this case, the User is held responsible for the unauthorized use of the Site.

The User will not interfere with the functioning of the Site or in the services, in particular, he/she/it will not impersonate another user or person. The User agrees not to carry out any action that may damage, make unavailable, overload, deteriorate or impede the normal use of the Site or the services, which may impact the security of the Site or the services, or which may in any way interfere with the services offered by the Company.

The User may not use "robot" software or attempt by any means (automatic or manual) to control or copy this Site and its content. Nor may the User alter the proper functioning of this Site in any way whatsoever, in particular by deliberately overloading the Site's infrastructure.

The User agrees not to use the Services negligently, for fraudulent purposes or in an unlawful manner. Likewise, the User agrees not to partake in any conduct or action that could damage the image, interests or rights of the Site or third parties.

The Company will take civil and criminal legal action against any illegal and/or unauthorized use of the Site.

ARTICLE 4 - LEGAL RELATIONSHIP

No legal relationship arises between the User and the Company through use of the Site without subscription to the Company's services.

General terms and conditions of sale govern the relationship between the Company and the subscriber to our services. The User does not acquire any rights or any license by using the Site.

ARTICLE 5 - INTELLECTUAL PROPERTY

The Site, the code, logos, design, assets of the Company and all other trademarks, logos and designs presented on this Site are protected by the Company and its partners as trademarks used or registered. Each of these trademarks, logos and designs may only be reproduced or used with the express written authorisation of the Company or its partner. The same applies to all the content and software on this Site, which remain the exclusive intellectual property of the Company and are protected by copyright.

Use of the Site does not give any right to the intellectual property rights of the Company or its partners.

ARTICLE 6 - LIABILITY

We make no warranty, express or implied, as to the accuracy of the information published on the Site. The Site is provided "as is" and "subject to availability", for your information and personal use only.

We shall not be liable to you for any loss of content or material resulting from loading or downloading from the Site.

You acknowledge that we cannot guarantee, and therefore accept no responsibility for, the security or confidentiality of the Site or any information supplied to or obtained from the Site by you.

ARTICLE 7 - CONFIDENTIALITY

The Privacy Policy governs the processing of data relating to Users of the Site.

####ARTICLE 8 - JURISDICTION AND APPLICABLE LAW Any dispute between the User and the Company must first be resolved amicably. If the Parties are unable to resolve the dispute, it shall fall exclusively within the jurisdiction of the courts of Nivelles and shall be governed by Belgian law.
